Judiciary dismisses probe plea in CCD shooting
Senior Magistrate of the Rawalpindi Judicial panel of the Lahore Regional judicial body, Fairness Sadaqat Ali Khan, has dismissed a judicial challenge legal challenge seeking a judiciary fact-finding process into the brutal killing of nine-year-old Pakistani-origin Australian student Hania and the serious injuries sustained by her father and brother.
The judiciary directed the petitioner to approach the appropriate legal forum and also instructed the Director Senior commander of the Federal Probe Bureau (FIA) to decide, after assembly session the applicant, on a request already submitted for an independent fact-finding process.
The legal challenge had been filed by Advocate Asif Mahmood. During Friday's assembly session, replies were submitted on behalf of the Punjab Inspector Senior commander of Police, the regional police officer and the sector police officer Chakwal.The respondents informed the judiciary that a case had already been registered in Chakwal, the charged individual had been arrested and the probe was proceeding on merit. They stated that the challan was expected to be submitted next week and requested dismissal of the legal challenge.
The assistant advocate senior commander contended that since an POLICE COMPLAINT REPORT had been registered, the charged individual arrested and the probe was in its final stages, there was no justification for constituting a legal evaluate body.
The petitioner's counsel contended that the police could not investigate allegations against themselves and demanded an fact-finding process by an independent bureau. He contended that indiscriminate firing by the CCD had killed Hania .
